Text and Data Mining (TDM) Policy

This Text and Data Mining (TDM) Policy sets forth the position of Thinking Habitats, LLC with regard to the use of automated technologies for the extraction and analysis of content—including but not limited to text, data, images, audio, video, code, and other materials—hosted on our learning platform at learn.thinkingpro.com (“the Platform”).

This policy applies to all digital content and services provided by Thinking Habitats, including our proprietary educational product and materials offered under the name THINKING PRO.


1. Reservation of Rights

All content on the Platform is protected by U.S. copyright law, international treaties, and, where applicable, EU Directive (EU) 2019/790 and the UK’s retained version of this directive. Thinking Habitats, LLC expressly reserves all rights with respect to the use of its content for the purposes of text and data mining, including those rights under:

  • Article 4(3) of Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market

  • Equivalent provisions under UK copyright law

  • Section 106 of the U.S. Copyright Act

2. Prohibition of Unauthorized TDM Activities

Unless prior written permission is granted, you may not use any automated system, bot, crawler, scraper, or other data extraction tool to access, extract, or analyze any portion of the content hosted on our Platform for the purposes of TDM or similar activity.

This prohibition includes, but is not limited to:

  • Systematic or automated access to course materials, multimedia content, assessments, or instructional text

  • Indexing, aggregating, or reproducing content for research, commercial, or machine learning purposes

  • Any form of access that violates our Terms & Conditions or Privacy Policy

3. Permitted Use for Human Users

This policy does not restrict lawful access to THINKING PRO materials by registered users (e.g., educators, students, or institutions) for the purpose of teaching, learning, or research as part of the intended educational experience.

However, users may not:

  • Reproduce large portions of content

  • Share credentials or grant automated systems access

  • Extract content to create derivative works, datasets, or corpora

4. Requests for Permission

Entities wishing to perform lawful TDM on any content hosted by Thinking Habitats must obtain prior written authorization.

5. Robots.txt and Technical Controls

We implement technical measures, including robots.txt, to restrict automated access to our Platform.

By attempting to bypass or ignore these measures, users may be in violation of applicable laws and platform terms.

 

6. Trademark Notice

THINKING PRO®, Thinking Habitats®, and all related names, logos, product and service names, designs, and slogans are trademarks of Thinking Habitats, LLC or its licensors.

Unauthorized use of these marks—including automated extraction, reproduction, or display of branding elements for training models, commercial indexing, or dataset creation—is strictly prohibited without prior written consent.

Use of our trademarks in metadata, machine learning training data, or derivative content is not permitted and may constitute infringement under U.S., EU, UK, and international trademark law.

 

7. Changes to this Policy

Thinking Habitats, LLC reserves the right to update or modify this TDM Policy at any time. Changes will be published on this page and are effective immediately upon posting.
